This Court continues to monitor the COVID-19 pandemic and will enter Orders as data and circumstances dictate.  The Court has the responsibility to balance the public-health risks involved with in-court appearances as it relates to fulfilling its constitutional and statutory duty to keep courts open to the public in a safe manner.

This Court has operated under Orders issued by the Mississippi Supreme Court and the national emergency declaration by the President of the United States of America since the declaration of COVID-19 being classified as a “global pandemic.” The resources for each of the aforementioned counties and the nature of the facilities in each of the aforementioned counties vary, including courthouse and courtroom layouts, the number of employees in each of the buildings, (which includes court staff and other personnel with various other offices), and availability of waiting areas.  Because litigants have to gain access to courtrooms it is imperative that the ingress and egress also fall within the confines of this Order.

The Court has the responsibility to monitor the available resources from the CDC as well as the MSDH and other resources available to determine how to effectively proceed in each of its facilities, being aware that many litigants and attorneys are mandated to make appearances in a forum that must remain safe an effective to ensure that their rights to appear in court are protected during this national emergency.

IT IS THEREFORE ORDERED that all persons entering the Chancery Courtrooms and Chancery Courthouses of the 10th Chancery District, shall wear face coverings and submit themselves to temperature checks until further Order of the Court.

A copy of this Order shall be filed in each county within the 10th Chancery District and displayed in each courthouse.
